Important Information About Rental Disclosure Statements (Victoria)

 In line with recent changes to the Residential Tenancies Act, rental providers and property managers now have additional responsibilities when leasing a property in Victoria. These changes aim to create a more transparent, fair, and safer rental market.

 

What is a Disclosure Statement?

A Disclosure Statement is a legal document that rental providers must complete before entering into a new tenancy agreement. It outlines important details about the property, allowing prospective renters to make an informed decision. 

It is a legal requirement that this statement be completed and signed by the rental provider (landlord) themselves. Legally, agents are unable to complete this on behalf of rental providers.

What Must Be Disclosed?

Rental providers must disclose relevant information about the property, which includes (but is not limited to):

  • Whether the property is currently for sale or impacted by any planning or building applications.
  • Any current or proposed building works.
  • If a mortgagee is taking enforcement action on the property.
  • Whether the property has been the site of a serious crime (e.g., homicide) in the past five years.
  • Whether the property meets Victorian minimum rental standards
  • Whether gas and electrical safety checks have been completed in accordance with the legal timelines.
  • The presence of any mould, asbestos, or drug-related contamination.
  • Whether the property is heritage listed.
  • Any building defects or known safety issues.
  • If there are applicable owners corporation rules.
  • Any unresolved disputes that could affect the property.

  • 该房产是否为受保护的文化遗产建筑。
  • 是否存在建筑缺陷或已知的安全隐患。
  • 是否适用大楼物业公司(Owners Corporation)的相关规定。
  • 是否存在未解决的法律纠纷或争议,可能会影响到房产。
